Rules of entry into and exit from the temporarily occupied territory of Crimea

On 9 May 2014 the Law of Ukraine ‘On provision of rights and freedoms of citizens and the legal order in the temporarily occupied territory of Ukraine’ entered into force (hereinafter referred to as ‘the Law’), by which, in particular, rules of entry into and exit from the temporarily occupied territory by individuals has been set out.

The text of the Law can be found on the website of the Parliament of Ukraine.

Under the abovementioned Law foreign nationals and stateless persons enter into and exit from the temporarily occupied territory only upon the special permission at the checkpoints of entrance and departure.

Rules of entry to the temporarily occupied territory by foreign nationals and stateless persons are being developed currently by the relevant authorities of Ukraine.

At the same time, in accordance with the Law, changes have been made to certain legislative acts as for responsibility for violation of the rules of entry into and exit from the temporarily occupied territory of Ukraine, namely:

1. The Criminal Code of Ukraine has been amended with Article 332-1:

- violation of the rules of entry into and exit from the temporarily occupied territory of Ukraine and departure from this territory aimed at inflicting damage to public interest shall be punished by imprisonment for up to three years or for the same term of imprisonment with confiscation of vehicles. Same actions, committed repeatedly or resulting from a conspiracy by a group of persons or from the actions of an official using his official position, shall be punished by imprisonment for a period from three to five years with a ban on holding certain positions or being able to carry out certain activities within three years, with confiscation of vehicles. The above-mentioned actions, committed by an organised group, shall be punished by imprisonment for a period from five to eight years.

2. The Code of Ukraine on Administrative Offences has been amended with Article 204-1 of the following content:

- violation of rules of entry into and exit from the temporarily occupied territory of Ukraine shall result in a fine of one to three hundred times of the untaxed minimum income of citizens or in an administrative arrest for a period of fifteen days.

3. Article 13 of the Law of Ukraine ‘On the legal status of foreign nationals and stateless persons’ has been amended with a paragraph of the following content:

A foreign national or  stateless person may not enter Ukraine where:

- a person tries to pass border checkpoints of the temporarily occupied territory without special permission or if a person during his/her previous stay in the territory of Ukraine departed from its territory through a border checkpoint;

Article 14-1 of the following content has been added as follows:

-  foreign nationals and stateless persons who have arrived to border checkpoints from the temporarily occupied territory without proper permission shall be denied to enry into Ukraine and immediately returned to the temporarily occupied territory from which they have arrived or to the country in which their travel document was issued.

If immediate return of a foreign national or a stateless person is impossible, such persons shall remain at the border checkpoint until they are returned back.

Such foreign nationals and stateless persons shall have their passports stamped with a denial of entry into Ukraine for a period, specified in the resolution in accordance with Paragraph 3 of Article 13 of this Law".

Article 20 has been amended with Part 4 of the following content:

- foreign nationals and stateless persons are not allowed to cross in transit through the temporarily occupied territory.

- rules set out by this Law shall remain in force until constitutional order of Ukraine is completely renewed on the temporarily occupied territory.

- the foreign nationals who plan to visit the Autonomous Republic of Crimea and the city of Sevastopol of Ukraine should be informed of this law.
