Add to calendar 2013-12-15 00:00:00 2013-12-15 00:00:00 Europe/Kiev Re-elections in Ukraine (for the attention of international observers) ON THE RE-ELECTION TO THE PARLIAMENT OF UKRAINE ON 15 DECEMBER 2013   On 15 December 2013 the re-election of the peoples’ deputies of Ukraine will be held in single-mandate constituencies No. 94, 132, 194, 197 and 223. Thus, the election campaign started on 16October 2013 (60 days prior the voting date). Ukraine has a firm intention to ensure that the re-election is held in a free, transparent and democratic way according to international standards. This intension also corresponds to Ukraine’s readiness to implement the EU Foreign Affairs Council recommendations of 10 December 2012 to establish a reliable electoral system. In this regard, foreign observers are welcome to take part in a monitoring of the electoral process. As a proof of Ukraine’s commitment to conduct these elections in compliance with international standards, Minister for Foreign Affairs of Ukraine Leonid Kozhara addressed the invitation to participate in a monitoring of the parliamentary elections to Janez Lenarčič, Head of OSCE/ODIHR. Similar invitations were sent on behalf of the Chairman of the Verkhovna Rada (Parliament of Ukraine) Volodymyr Rybak to the heads of European Parliament, NATO Parliamentary Assembly, OSCE, Council of Europe, GUAM Organisation for Democracy and Economic Development, BSEC (Organisation of the Black Sea Economic Cooperation) and IPA CIS (Interparliamentary Assembly of the Commonwealth of Independent States). The application deadline for the observers is 9 December, as stated by the Central Election Commission (CEC) of Ukraine. Accreditation documents must be submitted to the CEC by 7 December respectively. The Registration Procedure of official observers from foreign states and international organizations on elections of the People’s Deputies of Ukraine (Annex 1) as well as appropriate Application Form (Annex 2) are defined by the Resolution of the Central Election Commission of 15 March 2012 No.49.

Annex 1

THE REGISTRATION PROCEDURE

of official observers from foreign states and international organizations on elections

of the Peoples Deputies of Ukraine

 

This Procedure is prepared under the provisions of the Ukrainian Law “On Elections of the People’s Deputies of Ukraine” (hereinafter “the Law”).

 

1. General Provisions

 

1.1. Activities of official observers from foreign states and international organizations at Elections of the People’s Deputies of Ukraine (hereinafter “people's deputy elections”) are regulated by the Law, generally recognized principles and standards of international law with regard to arranging and managing the election.

1.2. An official observer from a foreign state or international organization during the people's deputy elections is a person proposed to be registered as an official observer at people's deputy elections by the relevant foreign state or international organization and is registered by the Central Election Commission in accordance with the law.

1.3. Official observers from foreign states and international organizations exercise their authority in Ukraine, and at overseas polling stations.

1.4. Official observers from foreign states and international organizations, registered in accordance with the Law, may monitor the election process.

1.5. The authority of official observers from foreign states and international organizations shall commence on the day following the day of registration by the Central Election Commission and terminate after the CEC releases results of the people's deputy elections.

1.6. The procedure of entry of official observers from foreign states and international organizations to the territory of Ukraine shall be defined by the Ukrainian Law “On the Legal Status of Foreigners and Stateless Persons” as well as the relevant enactments of the Cabinet of Ministers of Ukraine.

1.7. The documents which enable official observers from foreign states and international organizations to exercise their authority are certificates issued by the Central Election Commission in an approved form. The certificate is valid upon showing the official observer’s ID.

 

2. Registration of official observers from foreign states,

International organizations

 

2.1. Official observers from foreign states, international organizations shall be registered by the Central Election Commission.

2.2. Citizens of Ukraine shall not be registered as official observers from foreign states or international organizations.

2.3. Documents for registration of official observers from foreign states and international organizations shall be submitted to the Central Election Commission - no earlier than the official start of the campaign and no later than seven days before the voting day.

2.4. Proposals for registration of official observers from foreign states and international organizations shall be the subject of a request submitted to the Central Election Commission directly or through the Ministry of Foreign Affairs of Ukraine by international organizations, foreign states’ diplomatic missions accredited in Ukraine.

2.5. The request to the Central Election Commission signed by the head of the relevant international organization or foreign state’s diplomatic missions accredited in Ukraine shall state type, title and the date of people's deputy elections to be observed, contact person (phone number) and the list of individuals proposed for registration as official observers. Along with the application form for each individual proposed for registration as an official observer from a foreign state, international organization in a form approved by the Central Election Commission shall supply a photocopy of passport or ID pages with family name, name and a photo of the person.

2.6. The international non-governmental organization shall also attach copies of constitutive documents (e.g. Charter etc.), which prove that electoral process and observation related issues are the part of organization’s statutory activities, as well as a certified copy of the document proving the international status of such organization.

2.7. In case of a mismatch between personal data of individuals proposed for registration as official observers, which is specified in the appeal or application and in application forms and/or in ID copies, they are to be returned for revision and correction. Corrected documents may be submitted to the Central Election Commission no later than seven days before the Election Day.

2.8. The Central Election Commission shall make its decision on registration of official observers from foreign states and international organizations no later than 5 days before the Election Day.

The Central Election Commission may refuse to register official observers from foreign states and international organizations in case documents submitted for registration are in non-compliance with the Law and this Order, or where submitted after the deadline of submission.

 

3. Premature termination of powers, canceling the registration of official observers from foreign states and international organizations

 

3.1. The Central election Commission may cease authority of an official observer from foreign state or an international organization in case he/she violates the Law by taking a respective reasoned decision.

3.2. In case a head of the corresponding international organization or foreign state’s diplomatic missions accredited in Ukraine sends an appeal for cancellation of proposed official observer or the official observer himself sends the personal application to terminate the authority, the Central Election Commission takes decision on cancellation of registration of such observers.
